Privacy Policy and Personal Data Processing Principles
Project "NODOUBTFIT"
The “NODOUBTFIT” project, operated under the company Sportuj s.r.o., Company ID: 24674818, with its registered office at Na Poříčí 1041/12, 110 00 Prague 1 (hereinafter referred to as the “Controller”), manages and processes personal data of its customers in the course of its activities.
These Personal Data Processing Principles (hereinafter referred to as the “Policy”) inform data subjects about the circumstances of the processing of their personal data and about the rights they have in relation to this processing.
1. Purposes of Personal Data Processing
The Controller processes personal data for the following purposes:
a) Contacting the customer based on their inquiry and providing information and services related to the special offer published on the website www.nodoubtfit.com;
b) Sending unsolicited commercial communications based on the Controller’s legitimate interest, which is direct marketing, in accordance with applicable law (in particular Article 13 of Directive 2002/58/EC of the European Parliament and of the Council and Section 7 of Act No. 480/2004 Coll., on certain information society services);
c) Sending commercial communications and for marketing and advertising purposes, provided that the data subject has granted consent for the processing of personal data for these purposes.
2. Scope of Personal Data
The scope of personal data processed by the Controller varies depending on the purpose for which the data is being processed.
a) For the purpose of contacting the customer and providing information and services related to the offer on the website www.nodoubtfit.com (hereinafter referred to as the “Special Offer”), the Controller processes the following personal data: first name, last name, email address, phone number, postal code, and, if applicable, customer company identification.
b) For the purpose of sending unsolicited commercial communications based on the Controller’s legitimate interest and/or sending commercial communications and for marketing and advertising purposes based on the data subject’s consent, the Controller processes the following personal data: first name, last name, email address.
c) In connection with customer activity on the website, the Controller may also process data such as IP address, time and duration of website visits, location, country, etc. For more information, see the Cookie Policy on the Controller’s websites (the Special Offer website and any additional sites of the Controller).
3. Voluntary Provision of Personal Data
The data subject provides their personal data to the Controller voluntarily. However, failure to provide personal data may affect the Controller’s ability to deliver services that rely on the necessary knowledge of information about the data subject, including their personal data.
4. Duration of Personal Data Processing
For the purpose of contacting the customer and providing information and services related to the Special Offer, the Controller processes personal data for the time necessary to provide the requested information or service.
For the purpose of sending commercial communications and for marketing and advertising purposes, the Controller processes personal data for a period that is necessary and proportionate to these purposes.
If the processing of personal data is based on the data subject’s consent, the data subject has the right to withdraw their consent at any time by sending an electronic message to chrenka.samuel@gmail.com or via the unsubscribe link included in the commercial communication. The withdrawal of consent does not affect the lawfulness of processing based on other legal grounds, in particular for the performance of a contract, provision of a service, or processing that was based on consent prior to its withdrawal.
5. Recipients of Personal Data
The Controller does not share personal data with anyone and does not provide it to any third parties. The recipients of personal data may only include processors who process the data on behalf of the Controller for the purposes stated above.

The Controller and, where applicable, its processors process personal data manually (in both printed and electronic formats) and electronically using automated means.
6. Rights of the Data Subject

The data subject has the following rights:
a) Right of Access to Personal Data
The data subject has the right to obtain confirmation from the Controller as to whether or not personal data concerning them is being processed, and, if so, to access such personal data and the following information:

the purposes of the processing;

the categories of personal data concerned;
-
the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
-
the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;

the existence of the right to request rectification or erasure of personal data or restriction of processing, or to object to such processing;
-
the right to lodge a complaint with a supervisory authority;
-
where the personal data are not collected from the data subject, any available information as to their source.
The data subject also has the right to request a copy of the personal data being processed, unless this would adversely affect the rights and freedoms of others. For any further copies requested by the data subject, the Controller may charge a reasonable fee based on administrative costs. If the request is made electronically, the data shall be provided in a commonly used electronic form, unless the data subject requests otherwise.
b) Right to Rectification
The data subject has the right to have the Controller rectify inaccurate personal data concerning them without undue delay. Considering the purposes of the processing, the data subject also has the right to have incomplete personal data completed, including by providing a supplementary statement.
c) Right to Erasure (Right to Be Forgotten)
The data subject has the right to have the Controller erase personal data concerning them without undue delay, and the Controller is obliged to erase personal data without undue delay where one of the following applies:

the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

the data subject withdraws consent and there is no other legal ground for the processing;
-
the data subject objects to processing for direct marketing purposes;
-
the personal data have been unlawfully processed;
-
the personal data must be erased to comply with a legal obligation under EU or Czech Republic law;
-
the personal data were collected in connection with the offer of information society services based on the consent given by a child.
d) Right to Restriction of Processing
The data subject has the right to request restriction of processing in the following cases:
-
the data subject contests the accuracy of the personal data, for a period enabling the Controller to verify the accuracy of the data;
-
the processing is unlawful, and the data subject opposes the erasure of the data and requests the restriction of their use instead;
-
the Controller no longer needs the personal data for processing purposes, but they are required by the data subject for the establishment, exercise, or defense of legal claims.
e) Right to Data Portability
The data subject has the right to receive the personal data concerning them, which they have provided to the Controller, in a structured, commonly used, and machine-readable format, and the right to transmit those data to another controller without hindrance from the Controller, where:
-
the processing is based on consent or on a contract with the data subject; and
-
the processing is carried out by automated means.
In exercising this right, the data subject also has the right to have the personal data transmitted directly from one controller to another, where technically feasible. The exercise of the right to data portability shall not adversely affect the rights and freedoms of others.
f) Right to Object
Where personal data are processed for direct marketing purposes, the data subject has the right to object at any time to processing of personal data concerning them for such marketing, including profiling related to direct marketing. If the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.
g) Right Not to Be Subject to Automated Decision-Making, Including Profiling
The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them. This does not apply if the decision:

is necessary for entering into or performance of a contract between the data subject and the Controller;

is authorized by Union or Member State law; or
-
is based on the data subject’s explicit consent.
In such cases, the data subject shall have the right to obtain human intervention on the part of the Controller, to express their point of view, and to contest the decision.
h) Right to Lodge a Complaint with a Supervisory Authority
The data subject has the right to lodge a complaint regarding the processing of their personal data by the Controller with a supervisory authority. In the Czech Republic, this is the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7.
In Slovakia, the authority is Úrad na ochranu osobných údajov Slovenskej republiky, Hraničná 12, 820 07 Bratislava 27.
